Presente progressive

Good morning everybody,
report herein the stantement from reading collection by Oxford bookworms.
"Drivers sit with their feet in front of them, so they are nearly lying down".
They are nearly lying down: present progressive? and why?

I am thinking it is 'lying'.

"...ARE nearly LYING down."

The present progressive tense is used for an on-going action in the present.
