Proposed Rules & Regulations Changes for Public Chauffeurs
The following lists the old rule(s) followed by the proposed rule(s). Due to the length of these rules, we will continue with these rules in later postings.

Old Rule No. 54 – 64.6
Shared Ride program-origination and hours.
The Shared Ride Program shall be in operation from Midway and O'Hare Airports, McCormick Place, and the United Center only. It shall only be in operation from the airports while ground transportation monitors (starters) are on duty. It shall only be in operation from McCormick Place at those times and from those cabstands designated by the Metropolitan Pier and Exposition Authority (MPEA) and when MPEA personnel authorized as starters are on duty. It shall only be in operation from the United Center at those times and from those cabstands designated by the Commissioner and when personnel authorized as starters by the Commissioner are on duty.

Rule No. 55 Shared Ride Program-passenger limit-boundaries.
a. Up to four (4) passengers shall be permitted to share a taxicab from either O'Hare or Midway Airport to the other airport or to any destination within the boundaries of 22nd Street (South), Fullerton Avenue (North), Ashland Avenue (West), and Lake Michigan
(East).
b. Up to four (4) passengers shall be permitted to share a taxicab from McCormick Place or the United Center to any destination(s) within the boundaries of Roosevelt Road (South), North Avenue (North), Halsted Avenue (West), and Lake Michigan (East).

Rule No. 56 Mandatory participation.
All City of Chicago taxicabs and chauffeurs shall participate in the Shared ride program.

Rule No. 57 Shared Ride program informational signs.
Shared Ride information signs shall be displayed inside the vehicle in full view of the passengers who have engaged the taxicab.

Rule No. 58 Shared Ride program waiting period.
a. When one passenger has entered the cab and the driver is unable to load any additional passengers within ten (10) minutes, the driver shall take the passenger at passenger's request to his destination at the taximeter's fare.
b. When two (2) passengers have entered the cab and the ten (10) minutes have expired the driver shall proceed as a Shared Ride cab. Under no circumstances shall a driver continue to wait for a fourth passenger after three (3) passengers have been loaded.

Rule No. 59 No solicitation.
No driver shall engage in solicitation for a Shared Ride at O'Hare or Midway Airports, McCormick Place or the United Center.

Rule No. 60 Shared Ride program--starter's authority.
The starter shall have complete authority to make final decisions pertaining to loading Shared Ride passengers at the airports, McCormick Place or the United Center.

B. O'HARE AIRPORT
Rule No. 61 O'Hare--passenger limit.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to Midway Airport for a fare of $25 per person or any destination within the designated boundaries for a fare of $15 per person.

Rule No. 62 O'Hare-standing area.
All taxicabs shall proceed to the staging area and then advance to the terminals as they are instructed. If a customer has requested from the starter a Shared Ride cab, the starter shall inform the first cab to proceed to the Shared Ride designated area while waiting for additional passengers.

C. MIDWAY AIRPORT
Rule No. 63 Midway-passenger limit.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination within the designated boundaries for a fee of $10 or to O'Hare Airport for a fee of $25 per person.

Rule No. 64 Midway-staging area.
All taxicabs shall be dispatched from the taxi staging area. A dispatcher starter shall call for taxicabs as they are needed. If a customer has requested from the starter a Shared Ride cab, the starter shall inform the first cab to proceed to the Shared Ride designated area while waiting for additional passengers.

D. McCORMICK PLACE
Rule No. 64.1 McCormick Place--passenger limit.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination(s) within the designated boundaries of Roosevelt Road (South); North Avenue (North); Halsted Avenue (West); and Lake Michigan (East) for a fare of $5 per person.

Rule No. 64.2 McCormick Place--standing area; passenger loading; starter's
authority.
a. All taxicabs shall enter the cabstand(s) at the rear and proceed to the designated passenger loading areas as they are instructed.
b. Diving is prohibited. No chauffeur shall accept for transportation any passengers at McCormick Place except at a designated loading area.
c. If a customer(s) is participating in the Shared Ride program, the MPEA starter shall load the passengers and direct the cab, if necessary, to proceed to a designated area while waiting for additional Shared Ride passengers.
d. Chauffeurs shall follow the instructions of starters at McCormick Place cabstands and passenger loading areas at all times.

E. UNITED CENTER
Rule No. 64.5 United Center--passenger limit.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination(s) within the designated boundaries of Roosevelt Road (South); North Avenue (North); Halsted Avenue (West); and Lake Michigan (East) for a fare of $5.00 per person. A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any specific destination designated by the Commissioner and posted at the staging area for the per person flat fare designated by the Commissioner and posted at the staging area.

Rule No. 64.6 United Center--standing area; passenger loading; starter's authority.
a. All taxicabs shall enter the cabstand(s) at the rear and proceed to the designated passenger loading areas as they are instructed.
b. Diving is prohibited. When starters are present and a shared-ride operation is in effect at the United Center, no chauffeur shall accept for transportation any passengers except at a designated loading area.
c. If a customer(s) is participating in the Shared Ride program, the starter shall load the passengers and direct the cab, if necessary, to proceed to a designated area while waiting for additional Shared Ride passengers.
d. Chauffeurs shall follow the instructions of starters at United Center cabstands and passenger loading areas at all times.

New Rule No. 14.02 – 14.15
Shared Ride Program – Origination and Hours.
The Shared Ride program shall be in operation from Midway and O’Hare Airports, McCormick Place, and the United Center only. It shall only be in operation from the airports while the Starters are on duty. It shall only be in operation from McCormick place at those times and from those Cab Stands designated by the Metropolitan Pier and Exposition Authority (MPEA) and when Authorized Personnel are on duty. It shall only be in operation from the United Center at those times and from those Cab Stands designated by the Commissioner and when Authorized Personnel are on duty.

Rule 14.03 Mandatory Participation.
All City of Chicago taxicabs and Chauffeurs shall participate in the Shared Ride program.

Rule 14.04 Shared Ride Program Informational Signs.
Shared Ride information signs shall be displayed inside the vehicle in full view of the passengers who have engaged the taxicab.

Rule 14.06 No Solicitations.
No Chauffeur shall engage in solicitation for a Shared Ride at O’Hare or Midway Airports, McCormick Place or the United Center.

The Starter or Authorized Personnel shall have complete authority to make final decisions pertaining to loading Shared Ride passengers at the airports, McCormick Place or the United Center. Chauffeurs shall follow the instructions of Starters at all times.

Rule 14.08 Shared Ride Program – Fares, Passenger Limit at O’Hare
A minimum of two (2) and a maximum of four (4) passengers traveling alone may; share a taxicab from O’Hare to any destination(s) within the Designated Airport Boundaries for a fare of $22 per person or Midway Airport for a fare of $35 per person.

Rule 14.09 Shared Ride Program – Staging Area at O’Hare
All taxicabs shall proceed to the staging area and then advance to the terminals as they are instructed. If a customer has requested from the Starter a Shared Ride cab, the Starter shall inform the first cab to proceed to the Shared Ride designated area while waiting for additional passengers.

Rule 14.10 Shared Ride Program – Fares, Passenger Limit at Midway.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination(s) within the Designated Airport Boundaries for a fee of $16 or to O’Hare Airport for a fee of $35 per person.

Rule 14.11 Shared Ride Program – Staging Area at Midway.
All taxicabs shall be dispatched from the taxi staging area. A Starter shall call for taxicabs as they are needed. If a customer has requested from the Starter a Shared Ride cab, the Starter shall inform the first cab to proceed to the Shared Ride designated area while waiting for additional passengers.

Rule 14.12 Shared Ride Program – Fares, Passenger Limit at McCormick Place.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination(s) within the Designated McCormick Place or United Center Boundaries for a fare of $7 per person.

Rule 14.13 Shared Ride Program – Standing Area; Passenger Loading at McCormick Place.
a. All taxicabs shall enter the Cab Stand(s) at the rear and proceed to the designated passenger loading areas as they are instructed.
b. If a customer(s) is participating in the Shared Ride program, the MPEA Starter shall load the passengers and direct the cab, if necessary, to proceed to a designated area while waiting for additional Shared Ride passengers.

Rule 14.14 Shared Ride Program – Fares, Passenger Limit at United Center.
A minimum of two (2) and a maximum of four (4) passengers traveling alone may share a taxicab to any destination(s) within the Designated McCormick Place or United Center Boundaries for a fare of $7 per person.

Rule 14.15 Shared Ride Program – Standing Area; Passenger Loading at United Center.
a. All taxicabs shall enter the Cab Stand(s) at the rear and proceed to the designated passenger loading areas as they are instructed.
b. If a customer(s) is participating in the Shared Ride program, the Starter shall load the passengers and direct the cab, if necessary, to proceed to a designated area while waiting for additional Shared Ride passengers.


Old Rule No. 65 – 68
Chicago Taxi Access Program ("Chicago TAP" Program)--
Description.
The Chicago TAP Program is administered by the Chicago Transit Authority and the Department of Consumer Services. Under the Program, eligible persons with disabilities receive vouchers that are valid for up to $10 towards one-way taxicab fares for trips within the City of Chicago. Public chauffeurs may participate in the Program only if they are certified to do so by the Commissioner. A bonus is paid to licensees who accept and submit vouchers for reimbursement pursuant to the Program. Copies of the Chicago TAP Program Rules and Regulations are available at the offices of the Commissioner and of the Chicago Transit Authority.

Rule No. 66 Public Chauffeur Chicago TAP Program Certificate.
No public chauffeur may: (1) operate a vehicle displaying the Chicago TAP symbol, (2) accept or submit for reimbursement any voucher pursuant to the Chicago TAP Program, or (3) otherwise participate in the Program, unless the public chauffeur has received certification to participate in the Program pursuant to these rules. A public chauffeur who wishes to be certified for participation in the Program must apply to the Commissioner and successfully complete a driver training program offered by the City. The driver training program shall consist of the following parts: (1) service orientation; (2) sensitivity awareness; and (3) program orientation. A public chauffeur will not be certified to participate in the program if his public chauffeur's license is under suspension or has been revoked.

Rule No. 67
A public chauffeur may participate in the Chicago TAP Program only if the holder of the public passenger vehicle license for the taxicab which he is operating is also certified for participation in the program.

Rule No. 68
a) Any public chauffeur who participates in the Chicago TAP program must comply with all Chicago TAP Program Rules and Regulations.
b) Any person who knowingly submits a fraudulent document or knowingly makes a material misrepresentation in connection with the Chicago TAP Program shall, in addition to the penalties described in Article VII of these rules, be subject to the revocation of his or her certification for participation in the CTA Program.
c) In addition to the penalties described in Article VII of these rules, the Commissioner may, after a hearing conducted pursuant to Article VII of these rules, be subject to the revocation of his or her certification for participation in the CTA Program.

New Rule No. 15.01 – 15.03
Certification and Participation Required in TAP.
All Chauffeurs must be TAP certified and participate in the TAP program.

Rule 15.02 TAP – Compliance with One-Call-a-Day Program.
In the event that a customer participating in TAP pre-arranges transportation with a Chauffeur without contacting the affiliation, the trip shall be included in determining the Chauffeur’s compliance with the one-call-a-day program if the following actions are taken:
(1) The Chauffeur, upon picking up the passenger, notifies the dispatcher of his affiliation or radio dispatch service that he has accepted a TAP passenger pursuant to a pre-arranged order.
(2) The affiliation and/or radio dispatch service enters the information regarding the trip in its general dispatch log, recording all information as required as if the request had been made directly to the affiliation and/or radio dispatch service; and
(3) The Chauffeur maintains a copy of the TAP voucher and presents it to the affiliation to verify the dispatch log entry and presents it to the Department upon request.
If the above actions are taken, the affiliation shall include the trip in the number of radio calls for service from Underserved Areas accepted and filled by the Chauffeur which the affiliation indicates on the Chauffeur’s compliance certification prepared by the affiliation.

Rule 15.03 TAP – Pre-arranged Transportation; Refusal of Service.
In the event that a customer participating in TAP pre-arranges transportation with a Chauffeur without contacting the affiliation and/or radio dispatch service and neither the Chauffeur or a replacement vehicle arranged by the Chauffeur fails to arrive at the agreed pick-up location within thirty minutes of the pre-arranged pick-up time, it shall be a rebuttable presumption that Chauffeur refused service to the customer.


Old Rule No. A-1
Hearings.
(A) Authority to hold hearings.
Hearings for violations of Rules and Regulations, Chapters 9-104 or 9-112 of the Municipal Code of Chicago and traffic laws shall be conducted by a Hearing Officer of the City of Chicago Department of Administrative Hearings.

(B) Conduct of hearings.
The Rules and Regulations for the Conduct of Administrative Hearing Proceedings which are promulgated by the City of Chicago Department of Administrative Hearings shall govern the conduct of hearings for violations of these rules and regulations.

(C) Penalties.
If any chauffeur shall violate any order, rule or regulation promulgated by the Commissioner, or any provision of Chapters 9-112 or 9-104 or any traffic law, the Commissioner may file charges with the Department of Administrative Hearings seeking to suspend the chauffeur's license, and/or impose a fine. The Commissioner may also recommend to the Mayor's License Commission the revocation of the chauffeur's license, all as provided in Article VII of these rules. In lieu of or in addition to such penalties, a chauffeur may be required to retake the public chauffeur course of study described in Rule 2.1.

(D) Failure to pay fine.
Absent an order by any court of competent jurisdiction, staying or enjoining enforcement of the administrative hearing officer’s order, the failure to pay any fine imposed by an administrative hearing officer within thirty days shall terminate the chauffeur's driving privileges until the fine is paid.

New Rule No. 16.01 – 16.02
Definitions.
For the purpose of this section:
a. “Repeated Offense” means a second or subsequent violation of any Department rule or regulation or MCC ordinance within a five (5) year period;
b. “Aggravated Offense” means (i) an intentional or reckless violation; (ii) an offense demonstrating reckless disregard for the public safety; or (iii) an offense designated as an Aggravated Offense by these rules.

Rule 16.02 Penalties.
Except as otherwise specified in particular rule or ordinance, any violation of these rules, Chapter 9-104 MCC, or Chapter 9-112 MCC shall be subject to the following penalties:
First Offense: $75 to $750 fine and/or license suspension up to five (5) days and/or revocation of Chauffeur license.
Repeated and/or Aggravated Offense: $200 to $750 fine; and/or license suspension up to twenty-nine (29) days and/or revocation of Chauffeur license.
