I think they're both okay.


Any such appeal must:

(1) be made in writing, addressed to the Warden (Mr John Smith), briefly setting out the grounds upon which the appeal is based, and
(2) be received within ten days of the date of this letter.

I would chop it up for clarity:

Any appeal must made within ten days of the date of this letter and submitted in writing to the Warden (Mr Robert Wilson). It should briefly state the grounds for the appeal.
