Hi Mike.
MOT testers don't, to my knowledge, lift the bonnet! Your bungeed battery should pass ok, although it probably isn't ideal.
My Marlin (sorry for cussing) went through its MOT a few months ago with the battery held in place - tightly - with a bungee. I don't believe this was checked; certainly no comment was made.
(Yes, I do also have an NG, hence a member of this club! One of them will have to go next year... I wonder which one 
)
